Terms and Booking Conditions of Uzbek Journeys Tours

Note: These terms and conditions apply to the 2018 Uzbekistan and Kyrgyzstan tours. For separate excursions, e.g., Termez, Ferghana Valley etc, the terms and conditions are similar, with minor variations. They will be sent directly to participants prior to booking confirmation.

Please read carefully the Terms and Conditions described below. By booking a tour with Uzbek Journeys (ABN: 72818242110, Travel Agents Licence 2TA0882) you are deemed to have agreed to these Terms and Booking Conditions and, provided there is availability, your booking will be accepted on this basis. After you check tour availability and wish to proceed, you will be sent a pdf file with these terms and conditions, the booking form and the participant declaration to be completed and returned, plus instructions on how to transfer your deposit.

If you have any queries regarding these terms and conditions, you must raise them with Uzbek Journeys prior to submitting those documents.

A non-refundable, non-transferable A$700 deposit for Uzbekistan tours and a non-refundable, non-transferable deposit of A$500 for Kyrgyzstan tours, as well as a completed booking form and signed participant declaration for each tour are required to confirm your reservation.

Your deposit will be converted into US$ based on Westpac Bank's A$-US$ telegraphic transfer rate of the date when the funds are deposited. You will then be advised of the US dollars balance.

The balance of the Uzbek Journeys tour cost is required at least 60 days prior to departure. Uzbek Journeys will send you a final invoice about 70 days prior to the tour start. If you book within 60 days prior to departure, full payment is required. Details of your comprehensive travel insurance cover must be provided prior to final payment.

Neither the deposit nor the balance payment may be applied to another tour: the cancellation conditions below will apply if you cancel your reservation on a specific tour. It is strongly recommended that you take out travel insurance with your broker or travel agent at the time of booking your Uzbek Journeys tour - the deposits are strictly non-refundable and non-transferable.

Please note that Uzbek Journeys reserves the right to unilaterally refuse an application without reasons given, and return the deposit.

Note: Any person 75 or over at the time of travel is required to provide a Fitness to Travel certificate from his/her doctor prior to paying the deposit and again prior to paying the tour balance.

Cancellations must be in writing, either e-mail or letter. Neither the deposit nor the balance payment may be applied to another tour: the cancellation conditions below will apply if you cancel your reservation on a specific tour. Please consider taking out an insurance policy at the time of booking a tour. You will need to discuss this with your insurance broker or travel agent.

More than 60 days in advance: A$700 (Uzbek tours) A$500 (Kyrgyz tours) per person
60 to 30 days prior to Day 1 in Tashkent or Bishkek:  50% of tour cost per person
Less than 30 days prior to Day 1 in Tashkent or Bishkek:  100% of tour cost per person

Airfares, other than those specified in your Uzbek Journeys tour itinerary, are not included in the cost.  Any cancellation conditions imposed by airlines should be clarified with your flight booking agent.

Uzbek Journeys endeavours to carefully monitor events in Central Asia. If, due to natural disasters or political instability etc, it is deemed safer to cancel the tour, Uzbek Journeys will refund you all monies paid to Uzbek Journeys minus an administrative fee of A$300. Other fees you may incur, e.g. flight cancellation penalties, passport costs etc are non refundable through Uzbek Journeys. Please refer to the section below on comprehensive travel insurance.

2018 Scheduled Tours to Uzbekistan and Kyrgyzstan Tour Costs

The Uzbekistan tours start and end in Tashkent. The Kyrgyzstan tours start and end in Bishkek. The basic tour cost, including those items specified in the itinerary, is stated in the tour information pages.

Any additional items not specified in the itinerary, such as flights, laundry, tips, visa and passport fees, medical costs, meals not specified, optional excursions etc are at your expense. Single supplements are indicated on the tour information pages. If you are travelling alone and have indicated that you would like to share a room, Uzbek Journeys will try to meet that request. If, however, that cannot be arranged, you must pay the specified single supplement.

The volatility of the Australian dollar and its dramatic decline against the US dollar means that the tours are now priced in US dollars. Payment to Uzbek Journeys, however, must be in Australian dollars, regardless of where you live. The exchange rate to be used will be the Westpac Bank's telegraphic transfer rate of the AUD and USD.

For deposits, the rate will be based on the date that funds are deposited into the Uzbek Journeys account. The final invoice will be issued about 10 working days before it is due. For balance payments, the telegraphic transfer rate will be provided based on the date the final invoice is raised. It will be valid for five (5) working days.

The Uzbekistan tour cost is based on a minimum of 10 and maximum of 13 participants. If fewer participants book, there will be a price increase. The price of the Kyrgyzstan tours varies according to group size. This is indicated in the tour costs information section online; prices are specified for 5, 6, 7 and 8+ persons. Maximum group size is 10. If fewer than 5 persons book, there will be a price increase and a different vehicle used.

Information sessions

Usually Uzbek Journeys offers a luncheon in the Blue Mountains for confirmed travellers about 6 - 8 weeks prior to the tour. It is an opportunity to meet other participants, discuss all aspects of the tour and view Penelope Price's collection of Uzbek and Kyrgyz objects. If you are unable to attend, participation via Skype or Viber is required.

Uzbek Journeys will advise travellers about the luncheon directly.

Custom and separate tours to Termez and the Ferghana Valley etc

For additional tours, your start and end cities in Central Asia will depend on your program. The tour cost, inclusions and exclusions will be clearly stated in your tour program and you will receive separate terms and conditions. Any additional items not specified in the itinerary, such as laundry, tips, visa and passport fees, medical costs, meals not specified, optional excursions etc are at your expense.

Your passport must be valid for at least six months after your arrival in Uzbekistan and/or Kyrgyzstan. Should you require re-entry permits to your country of residence, it is your responsibility to obtain them. Most foreign nationals require a visa to enter Uzbekistan. You must apply for a visa in your country of residence if there is an Uzbek consulate or embassy there. 

If your country of residence does not have an Uzbek embassy, then Uzbek Journeys will arrange a Letter of Introduction (LOI) to facilitate travel.  You must travel with this LOI. Your visa will be issued by Uzbek authorities on arrival at Tashkent airport upon payment of the appropriate visa fee in US$ cash and presentation of the LOI.  Uzbek Journeys will advise about these matters after your tour has been confirmed. Most nationalities do not require a visa for Kyrgyzstan for stays up to 60 days.

It is your responsibility to advise Uzbek Journeys of any pre-existing medical conditions and/or disabilities that might reasonably be expected to increase the risk of you requiring medical attention, or that might affect the normal conduct of a tour and the enjoyment of other tour members if you are participating in a group tour.

It is also your responsibility to ensure that you obtain any vaccinations or preventative medicines for the countries you are visiting. Uzbek Journeys does not provide medical advice. Please consult your doctor.

If requested by Uzbek Journeys, you may be required to provide an assessment of your medical condition by providing a ‘Fitness to Travel’ certificate from your doctor. Based on that certificate, Uzbek Journeys reserves the right, at its reasonable discretion, to cancel your booking and refund the money paid by you, less any unrecoverable costs. Uzbek Journeys also reserves the right to cancel your participation in a tour at any time, including after the commencement of your tour, with no right of refund if your medical conditions and/or disabilities could be reasonably expected to affect the normal conduct of the tour and the enjoyment of other tour members.

The tours include a lot of walking and standing in historic sites, often in the sun.  Also, none of the hotels where you stay have elevators, only stairs, sometimes steep. Please bring a torch as the footpaths and roads can be uneven. Please note that Uzbekistan are Kyrgyzstan are developing countries and public toilet facilities may be basic.

There will be no medically qualified escorts on the tour unless, by chance, a fellow participant has medical qualifications.

Travel insurance is not included in the tour price. Comprehensive travel insurance, providing cover against personal accident, death, medical expenses and emergency repatriation is a condition of participating in an Uzbek Journeys tour. It is strongly recommended that it also cover cancellation, travel interruption, personal liability and baggage loss. And, you should also consider that it is not possible for Penelope Price, operator of Uzbek Journeys, to obtain Public Risk cover for risks in Central Asia. Therefore it is not possible for you to rely on any such cover. Please arrange this with your flight booking agent or insurance company. Details of your comprehensive insurance cover, in the form of a copy of your insurance certificate and emergency contacts of your insurer, must be provided at the time of final payment.

Travel descriptions, itineraries and activities described in the tour information are indicative and prepared with good intentions but may be changed at any time for any reason. It is possible that the itinerary could change due to weather, political restrictions, transport delays, airline schedule changes or any other unforeseen circumstance. Under no condition will Uzbek Journeys, Penelope Price, Steppe Journeys (the land operator in Uzbekistan) or Kyrgyz Journeys, (the land operator in Kyrgyzstan) accept liability whatsoever in respect of such changes except as follows: Steppe Journeys and Kyrgyz Journeys have informed Uzbek Journeys that they will arrange a refund as best as possible for any unused services and will assist in arranging alternative transport or accommodation in Uzbekistan or Kyrgyzstan.

Limitation of liability
Uzbek Journeys contracts with a network of companies and individuals to assist in the running of tours and acts as an agent for these third parties.  Uzbek Journeys is not responsible for the acts and omissions of these third parties.

To the fullest extent permitted by law:

•    any liability for any loss, death, injury, damage or loss of enjoyment which you or your family may suffer (directly or indirectly) in connection with or arising out of your participation in a tour, or any breach of the Booking Conditions, is excluded;
•    you release Uzbek Journeys, Penelope Price, Steppe Journeys, Kyrgyz Journeys and their representatives from any liability and expressly waive any claims you may have against them arising out of or in connection with your participation in a tour; and
•    any condition or warranty that would otherwise be implied by law into these Booking Conditions (Implied Warranty), is excluded.

Uzbek Journeys tours are led by Uzbek guides in Uzbekistan and Kyrgyz guides in Kyrgyzstan. The decision of the tour leader is final on all matters likely to affect the safety or well being of any person participating in the tour. If you fail to comply with a decision made by the tour leader, or interfere with the well being of the group, the tour leader may order you to leave the tour immediately, with no reply or recourse and no right of refund.  You must accept the tour leader's decision and you must at all times comply with the laws and customs of Uzbekistan and Kyrgyzstan.

I have read and understood the terms and conditions of this booking and, if in doubt as to the meaning of this entire document and the possible consequences for me and my family, in the event of injury or loss I have been advised to seek legal advice. I agree to take out comprehensive travel insurance that covers personal accident, death, medical expenses and emergency repatriation. I will provide details of this insurance prior to final payment. I understand that prices, itinerary, schedules and services can alter without notice for any reason.

I am aware that risks and dangers exist during any travel. I am also aware that you (Penelope Price) do not have any public risk cover because it is impractical to obtain for travel in Central Asia and expressly and comprehensively exclude you from any claims and expressly and comprehensively indemnify you against any claims that I or my personal representatives may have or might arise that would otherwise be covered by public liability cover if the travel took place in Australia. I understand and agree that travel by its nature implies a standard of comfort, safety conditions and health different to my home environment, and that these conditions can vary markedly from day to day. By participating in this program I accept the risks associated with travelling away from my home and normal living places.

When considering whether to participate in this Uzbek Journeys tour, I have decided to accept and assume all risks. I am aware that all arrangements are made on condition that Uzbek Journeys, Penelope Price, Steppe Journeys, Kyrgyz Journeys and other companies, authorities, departments and persons associated shall not be liable for any injury, damage, loss, accident, death or irregularity suffered.
